1. Agreement
By creating an account, purchasing leads, or using any Lead-Spy services, you ("Customer," "you") agree to these Terms of Service. If you do not agree, do not use our services.
2. Service Description
Lead-Spy provides compiled property data — including property addresses, owner names, mailing addresses, and building permit history — sourced from publicly accessible government records. This data is provided to help roofing contractors identify potential customers for direct mail marketing.
3. Data License & Permitted Use
When you purchase leads from Lead-Spy, you receive a limited, non-exclusive, non-transferable license to use that data for your own business's direct mail and marketing purposes.
You MAY:
→ Use the data to send direct mail, postcards, or other marketing materials from your business
→ Import the data into your own CRM or mailing systems
→ Use the data for door-to-door canvassing by your own team
You MAY NOT:
→ Resell, redistribute, sublicense, or share the data with any third party
→ Publish the data online or make it publicly accessible
→ Use the data for any unlawful purpose, including harassment, stalking, or discrimination
→ Combine our data with other data sources to create derivative products for sale
→ Transfer your account or purchased data to another person or business
Violation of these terms may result in immediate account termination without refund.
4. Data Accuracy Disclaimer
Lead-Spy data is sourced from publicly accessible government records, including municipal permit databases and county property appraiser records. We do not guarantee the accuracy, completeness, or timeliness of this data.
Specifically:
→ Leads indicate the absence of a roofing permit on record — not a confirmed roof condition
→ A homeowner may have replaced their roof without obtaining a permit
→ Permit records may have delays, gaps, or data entry errors beyond our control
→ Owner names and mailing addresses may be outdated if property has recently changed hands
→ Coverage varies by jurisdiction and depends on the availability of public records
You acknowledge that Lead-Spy data is a marketing tool to identify likely prospects, not a guarantee of roof condition or homeowner intent.
5. Suppression & Do Not Mail
Lead-Spy maintains a suppression list of homeowners who have requested to be excluded from our data. We filter suppressed addresses from all lead exports and direct mail campaigns. You agree to honor any opt-out requests that come to you directly from homeowners who received mail based on Lead-Spy data.
6. Payment & Refunds
Lead data purchases are non-refundable, as data is delivered immediately upon purchase. For direct mail campaigns, contact us before printing begins if you need to cancel. Subscription credits expire at the end of each billing period and do not roll over.
7. Limitation of Liability
To the maximum extent permitted by law, Lead-Spy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or data, including but not limited to lost profits, lost revenue, wasted marketing spend, or business interruption.
Our total liability for any claim arising from these Terms or your use of our services shall not exceed the amount you paid to Lead-Spy in the 12 months preceding the claim.
You agree to indemnify and hold harmless Lead-Spy from any claims, damages, or expenses arising from your use of the data, including any claims by homeowners or third parties related to your marketing activities.
8. Account Termination
We reserve the right to suspend or terminate your account at any time if we believe you have violated these Terms, particularly the data license restrictions in Section 3. You may delete your account at any time by contacting support@lead-spy.com.
9. Changes to Terms
We may update these Terms from time to time. The "last updated" date at the top indicates the most recent revision. Continued use of our services after changes constitutes acceptance of the updated Terms.
10. Governing Law
These Terms are governed by the laws of the State of Florida. Any disputes shall be resolved in the courts of Palm Beach County, Florida.
